Terms of useI. DEFINITIONS Art. 1. This document contains the terms of use of the services offered by SC BUNT STUDIO SRL through Bunt Hosting (http://www.bunthosting.com) . Art. 1.1. Bunt Hosting - defines and denotes SC BUNT STUDIO SRL Bucharest, Str Papiu Ilarian no. 4, Sector 3, Bucharest, Romania RO21181716 tax code, the PROVIDER of hosting and domain registration which can be contracted and purchased through Bunt Hosting (http://www.bunthosting.com).
II. INTRODUCTION Art. 2. This document defines the context in which Bunt Hosting agrees to provide the services to clients and users. This document is an agreement between Bunt Hosting and its clients. All hosting clients and service users are the subject of these terms and conditions so that the use of Bunt Hosting services implies accepting and complying the Terms of use. Art. 2.1. Bunt Hosting reserves the right to amend this document, but this is not a reason for ceasing collaboration nor for the customer to refuse payment for hosting services. III. ORDERS, PAYMENT AND BILLING Art. 3. Any order will be purchased online, on Bunt Hosting's web page (http://www.bunthosting.com). Clients are obliged to introduce in the form their complete, correct and accurate data. Domain registration is done in accordance with applicable laws. Bunt Hosting can not be held responsible in any way for any inconvenience caused by providing incorrect or incomplete information by the customers. Art. 3.1. After finalizing the order, an invoice is automatically sent to the email address entered on the form. The invoice contains all the necessary information for making the payment and it is available online in the customer's account. This invoice has no accounting value. Art. 3.2. Customer agrees to pay for the services in advance for the time period in which they are provided. Art. 3.3. All the invoices will be sent via email and a printable version will be available for the client in the control panel. Customers must pay the invoice in advance at the beginning of each pay period, within 5 working days from the invoice issue date. Art. 3.4. After receiving the payment, a bill will be issued. The bills will be sent via email, in "PDF" format in accordance with Emergency Ordinance no.106/2007, for amending and supplementing Law no. 571/2003 regarding the Fiscal Code published in Official Gazette, Part I no. 703/18.10.2007 Article 155, the following paragraph: (11) Romania will accept documents or messages on paper or in electronic form as invoices. Art. 3.5. Customers benefit Bunt Hosting services within 24 hours after the confirmation of payment. Art. 3.6. Suspension - We reserve the right to suspend any account after 14 days have elapsed from the due date if payment was not made. Any postponement will be at our discretion. Art. 3.7. Payment (Direct or Bank Transfer) - All bills and direct payments (cash payment) or bank transfer to Bunt Hosting are processed in RON. Prices listed on this website are in Euros. Art. 3.9. Online Payment (Credit / Debit Card) - Online payments are made via www.epayment.ro and they are subject to their terms and conditions. Please read these terms and conditions here. IV. DOMAIN REGISTRATION Art. 4. Domain registration is done after the confirmation of payment for the invoice issued for the services of domain registration, regardless the type of domain .ro, .eu, .com etc. Art. 4.1. Domain registration is done in accordance with general rules imposed by ICANN (Internet Corporation for Assigned Names and Numbers). Depending on the type of the domain, administrator TLD (Top Level Domain) requires clear rules of registration and use of internet domains. Art. 4.2. RO Domains – Bunt Hosting is a ROTLD partner and .RO domain registration involves reading and acceptance of all required rules of ROTLD: http://requests.rotld.ro/reguli.html?lang=en şi http://requests.rotld.ro/contract.html?lang=en. Art. 4.3. .EU Domains – Bunt Hosting provides . EU domain registration, renewal and transfer services in accordance with rules set by EURid (European Registry of Internet Domain Names) and .EU domain registration assumes reading and accepting all the rules imposed and regulated by EURid. Art. 4.4. International Domains – Bunt Hosting provides services of international domain registration, renewal and transfer through the partnership with eNom (Enom, Inc.. Chicago, IL), according to the rules for each type of domain imposed by the administrators of TLDs (Top Level domain).
V. WARRANTIES AND REFUND Art. 5. Customers are entitled to a refund for hosting services within 30 days from placing the order. Clients will request this by email to support@bunthosting.com. The message must contain the customer's personal data, the reasons for requesting a refund, and the information required for this operation. The payment will be made within 30 days from the receipt of the request for reimbursement. Art. 5.1. Payment for domain registration is not refundable. If the refund is required for the hosting services, the price for the domain registration is deducted from the total amount. This applies also for customers who received free domain registration or a certain discount in a promotional offer. Art. 5.2. Refund guarantee does not apply for extension or renewal of web hosting services. Art. 5.3. Refund guarantee does not apply if a hosting account violated these Terms and Conditions. Art. 5.4. After 30 days, refunds won't be made for the accounts with monthly billing cycle. The accounts for which has been established a billing cycle for a period longer than one month are entitled to refund by staging the payment, on the monthly refund calculation taking into account only full months, and the total amount reimbursed will be equal to the sum amount paid by the customer less the amount for domain registration and the amount due for each month the client has received our services, without the monthly discount provided for advance payment. If the account cancellation is due to violation of these Terms and Conditions by the client, there will be no refund. Art. 5.5. In case of unavailability (downtime) of services for a long period of time that accounts a higher average than 0.1% from a month, the client is entitled to compensation that may not exceed the amount of the monthly hosting package. These damages are awarded by the following formula: "package price multiplied (x) by the percentage of downtime (%)". Compensation is offered only on customer's request in the form of credit which is allocated to customer's account, expected to be dropped from the next invoice. VI. USE OF SERVICES Art. 6. The services provided by Bunt Hosting will be used only for legal purpose. Any activities that might be considered illegal are strictly prohibited. Art. 6.1. Bunt Hosting reserves the right to delete or block access to the content on the website or the server without previous notice. The right of using Bunt Hosting services will be reestablished after the account becomes legal. Art. 6.2. If a reseller account violates the provisions of this document, we reserve the right to suspend this account without previously informing the reseller. The end user won't be contacted by us, the reseller (customer) of Bunt Studio will be informed about our actions and reasons. Art. 6.3. Our servers will not be used in any way and any circumstance for transmission, storage or publication of any unlegal material (according to the laws of Romania, EU and U.S.). Illegal material include, but they are not limited to:
Art. 6.4. Sending mass e-mail refers to messages sent to large number of email addresses (once or regularly). Sending mass should respect international and romanian laws in force. Ignorance of law does not exempt no one of liability. Such campaigns can be operated only by e-mail lists where people personally subscribe to receive such messages (by express consent) and all messages must publish the procedure of withdraw from the lists. Sending Unsolicited Commercial Email (SPAM) to promote any site using our servers or other servers promoting any website hosted on our servers will result in the suspension or cancellation of customer's hosting account, without the right of refund. Mailing lists can be operated in conditions where people subscribe to receive messages by "opt-in" and are published in all messages the proceedings for removal from the mailing lists. Any complaints received in this regard will be investigated and action will be taken as necessary. A message can be considered spam even if:

Using the online forms for sending e-mails is made only through secure scripts to which access is restricted by password or anti-robot systems. Failure of these provisions result in the disable of scripts or account suspension. Art. 6.7. Pornography or other sexual or obscene content, links about pornography, are forbidden on our servers. Bunt Hosting reserves the right to decide regarding the legality of such sites Art. 6.8. The use of the following scripts on our servers is strictly forbidden:
VII. USE OF RESOURCES Art. 7. All accounts are monitored for their use of server's resources. If an account is using a large amount of resources, we will contact the customer to discuss the issue. If an account is using a large amount of resources (memory, CPU), account may be suspended or script disabled without prior notice to the client to maintain the smooth running of the server. In web hosting and reseller "Shared Hosting" packages will not accept users consumers of large amount of resources. Bunt Hosting oversees the compliance of the above by monitoring the reports about the used resources. Art. 7.1. Customers can request a package upgrade or temporary upgrade the resources. Customer's sole responsibility to contact us in advance for requiring extra resources to prevent account suspension. In some cases, accounts are automatically suspended when their resource limits are reached, and for the reactivation is required manual intervention on our part. VIII. RESTRICTIONS Art. 8. We reserve the right to impose hardware and software restrictions on using Bunt Hosting servers without any prior notice, if known security problems can lead to malfunction or operate server programs installed on the server. IX. PRIVACY. PROCESSING OF PERSONAL DATA Art. 9.1 According to Law no. 677/2001 on the protection of individuals regarding the processing of personal data and free movement of such data, modified and supplemented and the Law no. 506/2004 on the processing of personal data and privacy protection in electronic communications sector, SC BUNT STUDIO SRL has the obligation to manage safely and only for specified purpose, the personal data you provide about yourself, your family member or another person. Purpose of collecting data is billing, settlement of requests, questions or customer complaints, allocation or offering discounts or additional services. You are required to provide all information requested on original sign, which is necessary to contact you. Your refusal or providing of false information results in your removal from our database and banning for further registrations. Art. 9.2. Recorded information is intended for use by SC Bunt Studio SRL. and may be disclosed to third parties only with your consent According to Law no. 677/2001, you have the right to access the data, the right not to be subject to individual decisions and the right to appeal to justice. You also have the right to oppose the processing your personal data and erasing data. To exercise these rights, you can submit a written, dated, signed and sent to the SC BUNT STUDIO SRL, Str. If some of your personal data is incorrect, please let us know as soon as possible. Art. 9.3. By filling in the newsletter form on the website http://www.bunthosting.com the user agrees to receive mail with commercial character, which promotes Bunt Studio's services. The user can unsubscribe using the same form. X. BACK-UP Art. 10. Backups are made by us daily. Still, we don't offer any guarantee for the integrity of these backups. We advise all customers to create and download their own backups from their control panel as a zipped archive containing the backups of all data and of the account's databases. XI. CUSTOMER'S RESPONSABILITIES Art. 11. Customer is responsible for updating contact information from the control panel, client area and billing data when needed. We cannot be held responsible for confusions in communication as a direct result of not making the necessary updates by the customer. Art. 11.1. Customer is responsible for maintaining safe the usernames, passwords and other sensitive information. If there is any doubt the customer is required to amend or request a change of login details by contacting our support staff. XII. LIMITED LIABILITY Art. 12. We cannot be held responsible for damage caused by a temporary downtime of our servers, for any reason that causes this. This includes damages arising from damage or loss of data. Customer agrees to indemnify and consider us harmless in connection with any claims, damages, including, without limitation, damages caused to third parties arising as a consequence of using the service which damages our client. Art. 12.1. Bunt Hosting offers free technical support to all customers to ensure smooth functioning of the services. XIII. GENERAL TERMS Art. 13. If, for any reason you are not satisfied with the services that we offer please contact us and tell us what the problem is to solve it. If we can not solve the problem and you want to stop the contract you can inform us so and receive back the money for the web hosting services paid in advance. Payment for the domain registration or for other services will not be returned. Art. 13.1. We will allocate all necessary resources to investigations for violations of systems or network security and will cooperate with authorities in the investigation of crimes. Customers who violate these terms may incur criminal or civil. Art. 13.2. We reserve the right to suspend the web hosting services if the client has debts accumulated to Bunt Studio SRL. from providing other services. Art. 13.3. For customers with multiple accounts and resellers, we reserve the right to suspend all accounts if the main account owner violates these terms in a manner deemed by us to be extremely serious. Art. 13.4. We are the sole able to judge what constitutes a violation of the terms and conditions above. Noncompliance with the terms and conditions above represents a reason for account suspension or deactivation.
